Court puts control order on dangerous dog

A dog owner has been ordered by a court to keep his dog under proper control in public places after it attacked another animal.

Ormskirk Magistrates Court granted a Dog Control Order on Misty, a female malamute owned by Andrew Milligan, aged 55, of Swanpool Lane, Aughton.

The court heard that Andrew Milligan was walking his dog in a public open space area off Victoria Road, Aughton. She was on the park with two larger dogs and was being exercised off the lead. On seeing another dog on the far side of the park, Misty proceeded to run across and attack a 12-year-old whippet cross breed dog called Cassie.

The malamute made the owners of Cassie fearful and they lifted their dog up to get it out of Misty’s reach. She subsequently bit and significantly injured one of Cassie’s back legs. The injured whippet cross breed dog required vet treatment, including an operation, which cost the owners £289.95.

West Lancashire Borough Council took civil action after the owners of the injured dog complained to its staff.

Magistrates found Mr Milligan’s dog to be dangerous and granted the order, which requires Mr Milligan to keep his pet under control. Mr Milligan was also ordered to pay £500 costs to the Council.

The control order also stipulates that Mr Milligan must take a series of other measures with regard to his dog. These include ensuring the dog is muzzled when in parks or public places until it completes a suitable training course with a provider agreed by the Council.  The trainer will provide a report to the Council to confirm both satisfactory behaviour and that the malamute is safe to be unmuzzled in a public place, at which point the requirement for muzzling will cease.

The order stipulates that Misty must be kept on a lead to both collar and chest harness at all times when in a public place.

Councillor Kevin Wright, portfolio holder for Community Safety, said: “We welcome the decision of the court in upholding our application for a dog control order in this case. This shows that dog owners must ensure their pets do not pose any danger to other animals or people, or they could face legal action.”
